1. About this policy
This policy explains how LP Airconditioning & Refrigeration WA (“we”, “us”, “our”) collects, uses, holds, discloses and protects personal information. LP Airconditioning & Refrigeration WA is a registered business name of the trustee for The Phillipson Family Trust, ABN 85 039 668 202. This policy applies to our website at lpaircon.com.au, our phone and email enquiries, our quoting and service work, and our dealings with suppliers, builders and government clients.
We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Where we provide services to or on behalf of a Western Australian public entity under a State services contract that applies the Privacy and Responsible Information Sharing Act 2024 (WA), we handle personal information collected for that contract in accordance with the Information Privacy Principles under that Act.
2. What personal information we collect
We collect only the personal information we need to quote, supply, install, service and maintain air conditioning and refrigeration systems, and to run our business. This usually includes:
- Your name, phone number, email address and postal or site address
- Your business or organisation name and your role, where you contact us on behalf of an employer
- Details of your property relevant to the work, including access instructions, site conditions, existing equipment, and photographs or measurements of the work area
- Details of your enquiry, quote, job, warranty claim or service history
- Payment and billing details, including purchase order numbers and account details
- Correspondence between us, including emails, text messages, call notes and messages sent through our website
- For job applicants, the information in your application, resume and references
- Technical information about your visit to our website, described in section 6
Photographs taken on site for quoting, installation records, compliance and warranty purposes may incidentally capture people or premises. We use these only for the job they relate to and for our records.
We do not seek sensitive information about you. If information of that kind is relevant to the work, for example a health reason for prioritising a repair, we collect it only with your consent and only to the extent necessary.
3. How we collect personal information
We collect personal information:
- Directly from you, by phone, email, in person, or through a form on our website
- From a person authorised to act for you, such as a family member, tenant, property manager or site contact
- From third parties who refer work to us, including builders, strata and property managers, real estate agents, insurers, equipment manufacturers and their dealer referral programs, and government clients
Where we receive your details from someone else, we take reasonable steps to satisfy ourselves that the information was collected lawfully and fairly, and we handle it under this policy.
4. Why we collect, hold, use and disclose personal information
We use personal information to:
- Respond to enquiries and prepare quotes
- Schedule, perform and invoice work, and arrange access to your site
- Order equipment and parts, and register and administer manufacturer warranties
- Maintain service histories and provide ongoing maintenance and breakdown support
- Meet our obligations under Australian standards, refrigerant handling and licensing requirements, work health and safety laws, and building compliance requirements
- Meet our obligations under contracts with clients, including government clients
- Manage payments, accounts and debt recovery
- Handle complaints, warranty claims, disputes and insurance matters
- Assess job applications
- Send you service reminders and information about our services, where you would reasonably expect this or you have consented
We disclose personal information only where it is necessary for these purposes, including to:
- Our technicians, installers and subcontractors performing your work
- Equipment manufacturers and suppliers, for ordering, warranty registration and technical support
- The client who engaged us, where you are a tenant, occupant or site contact and we were engaged by a landlord, builder, strata manager or government body
- Our IT, hosting, email, accounting, payment and business software providers
- Our insurers, accountants, auditors and lawyers
- Government bodies, regulators or courts, where required or authorised by law
We do not sell personal information, and we do not disclose it for another organisation’s marketing purposes.
5. Direct marketing
If we send you service reminders, seasonal maintenance offers or other marketing messages, every message will identify us and include a way to opt out. You can opt out at any time by using the unsubscribe link, replying to the message, or contacting us using the details in section 12. We will action your request promptly. We do not use or disclose sensitive information for direct marketing.
6. Our website
Website hosting and forms. Our website is hosted in Australia. When you submit our contact form, the details you enter are emailed to us and are also stored in our website’s database. We do not store the IP address of the device used to submit the form. Stored enquiries are automatically deleted after 90 days, as described in section 10.
Analytics. We do not currently use website analytics tools. If we introduce them, we will update this policy to describe what is collected.
Advertising. We may advertise through Google Ads or similar platforms. If we do, those platforms may use cookies or similar technologies on our website to measure the performance of our advertising and to show our ads to people who have previously visited our site. This does not identify you to us by name. You can manage advertising personalisation at https://myadcenter.google.com and opt out of interest-based advertising from participating providers at https://optout.aboutads.info. Google’s handling of this information is described at https://policies.google.com/privacy and https://policies.google.com/technologies/partner-sites.
Google Maps. Our contact page includes an embedded Google Map. When the page loads, Google receives your IP address and information about your visit. Google’s privacy policy applies to that information.
Cloudflare Turnstile. We use Cloudflare Turnstile to protect our contact form and our website administrator login page from automated abuse and spam. The Turnstile widget is visible on the contact form. When you use a protected form, Turnstile collects technical signals from your browser, including your IP address, browser and device characteristics and connection details, and sends them to Cloudflare, Inc. in the United States solely to distinguish genuine visitors from bots. Cloudflare also uses this information to improve its bot detection technology. Turnstile does not use cookies to identify or track you and does not use your information for advertising. Cookies. Our website uses cookies and similar technologies for essential site functions such as security and session handling, and, if we begin advertising, for the purposes described above. Most browsers let you block or delete cookies. Blocking essential cookies may stop parts of our website working properly.
7. Dealing with us anonymously
You can ask us general questions about our services by phone without identifying yourself. We cannot quote, book, invoice or service a job without knowing who you are and where the work is.
8. Automated decision making
We do not use computer programs or artificial intelligence to make decisions about you that could significantly affect your rights or interests. Quotes, scheduling and warranty decisions are made by our people. If this changes, we will update this policy and describe the information used and the kinds of decisions involved.
9. Overseas disclosure
Some of our service providers store or process information outside Australia. This includes Google and Cloudflare, which are located in the United States, and may include other providers whose data centres are located overseas. Where we disclose personal information to an overseas recipient, we take reasonable steps to ensure it is handled consistently with Australian privacy law.
Where we hold personal information under a contract with a Western Australian public entity that applies the Privacy and Responsible Information Sharing Act 2024 (WA), we do not disclose that information outside Australia except as permitted under that Act.
10. How we protect and retain personal information
We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. These steps include restricting access to our systems, using secure passwords and multi-factor authentication, keeping our software up to date, using reputable Australian hosting and IT providers, and securing paper records at our premises.
We keep personal information for as long as we need it for the purposes described in this policy, and for as long as we are required to keep it under law, including tax, work health and safety, warranty and contractual record keeping requirements. When it is no longer needed, we destroy or de-identify it.
Enquiries submitted through our website contact form are stored in our website database and automatically deleted after 90 days. Where an enquiry becomes a quote or a job, the relevant details are transferred to our business records and retained under the periods above.
If a data breach occurs that is likely to cause serious harm, we will notify the affected individuals and the relevant regulator as required by law.
11. Accessing and correcting your information
You can ask us for a copy of the personal information we hold about you, and ask us to correct it if it is wrong, out of date, incomplete or misleading. Contact us using the details in section 12. We may need to verify your identity.
We will respond within a reasonable period, and within 45 days where the request concerns information we hold as a contracted service provider under the Privacy and Responsible Information Sharing Act 2024 (WA). There is no charge for making a request. If we refuse access or correction, we will tell you why in writing and how you can complain.
